Standard Terms & Conditions

1. In these Terms and Conditions, "Mobile.Cards" refers to Wee Creation Company Limited or its affiliated companies (including Mobile Cards Technologies Pte. Ltd.), or the Mobile.Cards entity listed on the service bill or receipt issued to you by Mobile.Cards
2. These Terms and Conditions apply to your relationship, rights, obligations, and responsibilities with Mobile.Cards concerning the use of the Mobile.Cards membership system services. This also includes any terms and conditions referenced in any contract you have with Mobile.Cards (Terms & Conditions). By using any resources within the Mobile.Cards membership system (including but not limited to CardsAPP, Door staff system, Door Pro staff system, mBooking service, mTakeOut service, and Office backend system - http://office.mobile.cards/ ), you signify that you have read and understood these Terms and Conditions and agree to be bound by them. The scope of these Terms and Conditions is not limited by the name of the membership system service. These Terms and Conditions constitute a legally binding contract between you and Mobile.Cards. If you do not agree with any content of these Terms and Conditions, you should not purchase or use any membership system services offered by Mobile.Cards. 3. The scope of the Mobile.Cards membership system services includes the development and maintenance of the consumer front-end within the membership system: Door staff system, Door Pro staff system, Office backend management, etc. The actual service content depends on the plan you purchase. The membership system services also include various third-party service providers (hereinafter referred to as "Third-Party Service Providers"), including but not limited to mobile application stores App Store - Apple and Google Play Store, login SMS authentication service Firebase, Facebook, and Amazon Web Services, etc. Depending on operational needs, Mobile.Cards reserves the right to add, delete, or modify third-party service providers on its own.
4. Through the Mobile.Cards Office backend management platform or other channels provided by Mobile.Cards, you can upload content by yourself and make it publicly available, including but not limited to the consumer front-end. Mobile.Cards is not responsible for any content you upload. You must ensure the accuracy of the relevant content and that you have complete ownership and intellectual property rights. If the content you upload does not belong to you, infringes on rights, is illegal, or violates the terms and conditions of any third-party service provider, Mobile.Cards has the right to remove such content without notice and terminate your usage rights. If such content causes any loss to Mobile.Cards, Mobile.Cards will seek compensation from you. In addition, some third-party service providers (including but not limited to App Store - Apple and Google Play Store) have the final decision on the publication of your content or application, and Mobile.Cards cannot and will not guarantee that your content will pass the review of third-party service providers.
5. Regarding the mobile applications for the Mobile.Cards membership system services, Mobile.Cards supports the iOS iPhone and Android Phone platforms. Mobile.Cards' system is compatible with the latest version and the previous two versions of the corresponding mobile operating system (for example: the current latest version of iOS is iOS15, and the application will be compatible with iOS13, iOS14, and iOS15; if the current latest version of Android is Android 11, the application will be compatible with Android 9, Android 10, and Android 11). Mobile.Cards is not applicable to Huawei phones and their software stores. Mobile.Cards does not guarantee the compatibility of the membership system service's mobile applications on other older versions, non-native Android systems of individual brands, tablet computers, laptops, or other software platforms.
6. You should ensure the information security of your software, hardware, and other electronic devices when using the Mobile.Cards membership system services, including but not limited to setting a strong password (recommended to be at least 8 characters long and include numbers, uppercase letters, lowercase letters, and special symbols), regularly changing passwords, and adjusting or revoking system usage permissions when personnel changes occur. Mobile.Cards is not responsible for any losses caused by your negligence in information security. You should also regularly back up all related data in the system. Mobile.Cards does not guarantee the completeness and accuracy of the information in the system.
7. All kinds of records generated by the system when you use the Mobile.Cards membership system services (including but not limited to points, top-ups, discounts, points, etc.) are only digital records and do not contain any actual value. In any case, Mobile.Cards will not be responsible for the accuracy and completeness of these digital records. You are responsible for regularly backing up and checking them yourself, and Mobile.Cards will not be responsible for any losses caused by system records.
8. The member data and related records collected by the membership plan launched through the Mobile.Cards system will not be transferred to other merchants by Mobile.Cards unless authorized by you.
9. You understand and acknowledge that the Mobile.Cards membership system service is a modular cloud service. Unless otherwise agreed in writing, the service does not include any customized content. The processes, interfaces, and designated third-party service providers in the system are standardized. Mobile.Cards does not guarantee the modifiability of any part of the existing service. Mobile.Cards will also update the system comprehensively from time to time. At that time, the processes and interfaces in the service system may change, and Mobile.Cards will not provide separate notice.
10. You understand and acknowledge that the service provided by Mobile.Cards only includes technical support for launching the membership system. You are responsible for resolving and handling all inquiries or complaints from your customers participating in the membership program.
11. The SMS verification service provided in the Mobile.Cards membership system services is provided by third-party service providers. Mobile.Cards cannot and does not guarantee that the charging policy of the third-party service provider will remain unchanged. Mobile.Cards reserves the right to change the relevant service fees in response to changes in the charging policy of the third-party service provider.

Currently, the content provided in the Mobile.Cards membership system services may be related to the policies of third-party service providers (including but not limited to push notifications, App Store and Google Play Store releases, login SMS authentication, POS suppliers, etc.). By using the Mobile.Cards membership system services, you also agree to the terms and policies of the relevant third-party service providers. If the terms, charging plans, or service policies of third-party service providers change, Mobile.Cards reserves the right to adjust the fees or change the relevant service providers accordingly. Mobile.Cards will notify you in writing at that time, and you will need to agree to the relevant changes to continue using the service.
Below are some of the relevant terms or policies of third-party service providers currently used by Mobile.Cards. The following terms do not represent all third-party service providers. Mobile.Cards also reserves the right to timely change various related third-party service providers in the system, and you need to regularly understand the relevant terms:
13. You understand and acknowledge that you will share part of the cloud server and database system with other users. Mobile.Cards has a fair usage policy. If your usage is significantly higher compared to other users, Mobile.Cards reserves the right to limit some functionalities to ensure the rights of other users. If necessary, you can discuss opting for the enterprise version service with Mobile.Cards to set up an independent dedicated server.
14. If due to your violation of these terms and conditions or the policies of third-party service providers, Mobile.Cards suffers any claims from any third party (including but not limited to other users of Mobile.Cards and third-party service providers), you shall fully compensate Mobile.Cards and keep Mobile.Cards harmless from any damages or losses. The scope of compensation includes but is not limited to the claim amounts of the third party and the reasonable expenses incurred by Mobile.Cards in handling such claims (including but not limited to legal fees and litigation expenses).
15. Under no circumstances will Mobile.Cards be liable for any losses suffered by you or any third party due to the use of the Mobile.Cards member system service (including but not limited to loss of income, loss of expected profits, data loss, system suspension, or direct, indirect, special, incidental, or punitive damages). The cumulative liability of Mobile.Cards for damages to you shall not exceed the service fees collected from you during the period of such liability.
16. You understand and agree that Mobile.Cards and each third-party service provider independently assume legal responsibilities, and there is no affiliated or partnership relationship between them. Mobile.Cards will not be held responsible for the acts or omissions of any third-party service provider. If there is any inappropriate behavior of any third-party service provider (such as breach of contract, infringement, etc.), you will need to claim compensation directly from that third-party service provider, not from Mobile.Cards.
17. To terminate the service, you must notify Mobile.Cards at least thirty days in advance. If the advance notice period is less than thirty days, the customer must pay the service fees for the entire last month.
18. If any provision within these terms and conditions is deemed invalid or unenforceable under any relevant laws or regulations, such invalid or unenforceable provision shall be automatically replaced by a valid and enforceable provision that best reflects the original intent or purpose of the provision, and the validity of the other contents of these terms and conditions shall not be affected.
19. Mobile.Cards reserves the right to modify, add to, or delete any content within these terms and conditions at any time. All updated terms and conditions will become effective upon publication or notification through the contact information you provide (including but not limited to email), and shall constitute a legally binding contract between you and Mobile.Cards regarding the Mobile.Cards member system service. The content and terms and conditions provided in the Chinese version shall prevail. Please make sure to regularly check the terms and conditions page provided by Mobile.Cards and pay attention to the notifications issued by Mobile.Cards to ensure that you are aware of and comply with the updated content of these terms and conditions.
